1. Parties and Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the Bajaj Integrated Health System Private Limited website and application portal (the “Site”). By actively clicking “I Agree”, or by accessing or using the Site, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease using the Site.

2. Eligibility and Credential Verification

You must be at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872, to use this Site and submit an application. For regulated or clinical roles, you represent and warrant that you hold valid, active registration and/or licensing with the relevant statutory council or board applicable to the role (e.g., as required under sector-specific healthcare legislation). You agree that Bajaj Integrated Health System Private Limited and its authorized third-party vendors reserve the right to independently verify your credentials, educational background, and employment history.

3. Permitted Use and Mandatory Prohibited Conduct

You agree to use the Site exclusively for bona fide job-application purposes only and under any circumstances shall not upload or share any information that:

• is false, misleading, or impersonated information;
• contains or transmits malware, automated scripts, or other harmful code; attempts to probe or breach our security or that of our providers;
• belongs to another person and to which you do not have any right;
• is defamatory, obscene, pornographic, pedophilic, invasive of another’s privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, or contrary to the laws in force;
• is harmful to children;
• infringes any patent, trademark, copyright, or other proprietary rights;
• deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature;
• impersonates another person, or contains fabricated electronic records, synthetically generated information (SGI), morphed images, or forged statutory licenses/certificates;
• contains software viruses, malware, or any other computer code, file, or program designed to interrupt, destroy, or limit the functionality of any computer resource; or
• threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order.

4. Company’s Rights

In the event of non-compliance with these Terms or applicable laws, we reserve the right to immediately terminate your access or usage rights to the Site and completely remove non-compliant information, without prior notice. Legal proceedings may be initiated for the submission of fraudulent clinical licenses or forged documents.

5. Application Submissions and No Offer Guarantee

The Site is merely a conduit for receiving applications. Submitting an application does not constitute an offer of employment, nor does it guarantee an interview, progression, or hiring. We reserve the absolute right to withdraw, modify, or close any vacancy at our sole discretion and without any liability to you.

6. Intellectual Property

The Site and its original content, including our name, logos, trademarks, layout, and descriptions, are owned by or licensed to us and are protected by applicable intellectual property laws. Except for the limited, revocable right to use the Site to submit applications, no rights are granted to you.

7. Privacy, Data Protection, and Consent

Your submission of personal data is governed by our Privacy Policy. By submitting your application, you provide explicit, informed consent for us to process your data in accordance with applicable law.

8. Security, Downtime, and Disclaimers

We implement reasonable security practices and procedures to protect your data. However, to the maximum extent permitted by law, the Site is provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted or error-free. We shall not be liable for any unavailability, technical failures, delay, corruption, or loss of application data arising from events beyond our control.

We may utilize third-party service providers, including Applicant Tracking Systems (ATS), background screening vendors, and communication gateways, to process your application. We do not own or control these third-party platforms. The Company assumes no liability for any errors, technical failures, data loss, or downtime caused by such third-party services. Your interaction with these integrations may be subject to the independent terms of use and privacy policies of the respective third-party vendors.

10. Limitation of Liability and Indemnity

To the fullest extent permitted by law, Bajaj Integrated Health System Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of your use of the Site. You agree to indemnify, defend, and hold harmless Bajaj Integrated Health System Private Limited, its affiliates, officers, and employees from any losses, liabilities, claims, and expenses (including reasonable legal fees) arising from your breach of these Terms, submission of fraudulent information, or misuse of the Site.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Mumbai, India.

12. Assignment

You shall not assign, transfer, or delegate any of your rights or obligations under these Terms without the prior written consent of the Company. The Company reserves the right to assign, transfer, or delegate its rights and obligations under these Terms to any affiliate, successor in interest, or third party without notice or your prior consent.

13. Force Majeure

The Company shall not be liable for any delay or failure to perform its obligations under these Terms resulting from causes beyond its reasonable control, including but not limited to acts of God, cyberattacks, network outages, server failures, governmental actions, or natural disasters.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitral tribunal of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be deemed modified to the minimum extent necessary to render it valid and enforceable.

15. Waiver

No failure or delay by the Company in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, nor shall any single or partial exercise preclude any other or further exercise thereof.

16. Entire Agreement

These Terms, read together with our Privacy Policy, constitute the entire legal agreement between you and Bajaj Integrated Health System Private Limited regarding your access to and use of the Site, superseding all prior oral or written agreements, understandings, or representations.

17. Amendments to the Terms

We reserve the right to update or amend these Terms. Your continued use of the Site following the posting of changes constitutes your acceptance of such changes.
